Subscription Plans and Payments
The Service offers various subscription plans with different features and usage limits. You may choose to subscribe to a paid plan to access additional features and higher usage quotas.Payments for subscription plans are processed through Stripe, a third-party payment processor. By subscribing to a paid plan, you agree to pay the applicable fees and any taxes in accordance with Stripe's terms of service.Subscription plans automatically renew at the end of each billing period unless canceled. You may cancel your subscription at any time, and your access to the paid features will continue until the end of the current billing period.
Intellectual Property
The Service and its original content, features, and functionality are owned by PixelPrompt and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.You may not copy, modify, distribute, sell, or lease any part of our Service, nor may you reverse engineer or attempt to extract the source code of the Service, unless expressly permitted by us in writing.
User-Generated Content
By using the Service to generate prompts or create images, you grant PixelPrompt a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the user-generated content in connection with the Service and PixelPrompt's business.You represent and warrant that you have the necessary rights and permissions to grant the above license for any user-generated content you submit through the Service.
Prohibited Uses
You agree not to use the Service:In any way that violates applicable federal, state, local, or international law or regulation.To generate prompts or create images that are defamatory, obscene, pornographic, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.To impersonate or attempt to impersonate PixelPrompt, a PixelPrompt employee, another user, or any other person or entity.To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm PixelPrompt or users of the Service, or expose them to liability.
Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.
Limitation of Liability
In no event shall PixelPrompt, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.
Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied.
Governing Law
These Terms shall be governed and construed in accordance with the laws of BC, Canada, without regard to its conflict of law provisions.
Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
